PRIVACY AND PERSONAL DATA PROTECTION POLICY

LIMITED LIABILITY COMPANY "HAISTER GIN", which is registered and operates in accordance with laws of Ukraine (identification code 44282607, address: 79067, Ukraine, Lviv region, Lviv, 17 Poetychna street; hereinafter - "HAISTER GIN"), establishes the following rules (hereinafter – the "Privacy Policy"), which regulate the collection, processing, use and protection of confidential and personal data that may be requested/received when using the website haistergin.com (hereinafter – the "Site"), owned by HAISTER GIN, by any persons who visit this Site (hereinafter – the "Visitors"):

1. DEFINITION OF TERMS

1.1. The terms used in this Privacy Policy shall be used in the following meanings:

1.1.1. "Product" is Ukrainian dry gin, produced by a Limited Liability Company "Scientific and Production Enterprise "HETMAN", which is registered and operates in accordance with laws of Ukraine (identification code 31804036, address of location: Ukraine, 81555, Lviv region, Lviv district, urban-type settlement Velykyi Liubin (z), Lvivska street, building 176) by order of HAISTER GIN and/or merch related to this product.

1.1.2. "Buyer" is a Visitor who, in accordance with the laws of Ukraine, is capable adult individual who places the Order on the Site to purchase the Product for purposes not related to the implementation of business activities, or a legal entity or an individual entrepreneur who places the Order on the Site to purchase the Product for purposes related to the implementation of one's own entrepreneurial activity.

1.1.3. "Personal data" - information or a set of information about the Visitor, who is identified or can be specifically identified while visiting the Site

1.1.4. "Processing of personal and other confidential data" is any operation, action or their combination, carried out with or without the use of automation tools with personal data: collection, recording, systematization, clarification, storage, accumulation (updating, changing), extracting, transfer, use (distribution, provision, access), depersonalization, deletion, blocking and destruction of personal data.

1.1.5. "Order" is the completed and placed application of the Buyer, addressed to HAISTER GIN, for the purchase of the Product.

1.2. All other terms used in this Privacy Policy are used in the meanings defined by the current laws of Ukraine.

2. GENERAL PROVISIONS

2.1. HAISTER GIN respects the right of all Visitors to privacy and recognizes the importance of protecting the information collected about them. In this regard, HAISTER GIN undertakes to protect the confidential and personal data of Visitors, which became known to HAISTER GIN in connection with the Visitor's visit and use of the Site. For this purpose, HAISTER GIN has adopted this Privacy Policy.

2.2. HAISTER GIN assures and guarantees that it will not collect, use or disclose confidential and personal data of Visitors otherwise than as provided by this Privacy Policy and the current laws of Ukraine.

2.3. This Privacy Policy applies exclusively to the Site. HAISTER GIN is not responsible for and does not control third-party sites to which the Visitor may go through links posted on the Site.

2.4. This Privacy Policy applies automatically to any Visitor from the moment he visits this Site. If the Visitor does not agree with this Privacy Policy, such Visitor should leave this Site and not use it.

2.5. HAISTER GIN does not control the authenticity of the personal data that the Visitor provides to it as the Buyer of the Product.

2.6. Taking into account the requirements of the laws of Ukraine regarding the restriction of consumption and sale of alcoholic beverages to minors, the Site is not intended for minors.

2.7. Legal relations not regulated by this Privacy Policy are regulated by the current legislation of Ukraine.

3. PURPOSE AND PERIOD OF PROCESSING PERSONAL AND OTHER CONFIDENTIAL DATA OF SITE VISITORS

3.1. Personal and other Visitors confidential data are processed for the purpose of selling/promoting the Product, in particular:

• fulfillment of Visitors' Orders for the purchase of the Products presented on the Site and provision of information exchange in this connection;
• evaluation of the quality of customer service;
• providing Visitors with up-to-date information about the Product;
• improving the quality of service for Visitors/Buyers;
• improving the effectiveness of the Site's content;
• providing assistance to Buyers through the customer support service;
• conducting market research;
• the implementation of other relations in accordance with the current laws of Ukraine, including in the field of advertising and communication (including, but not limited to, the Law "On the Protection of Personal Data", the Law "On Information", the Law "On Advertising", the Law "On protection of information in information and telecommunication systems").

3.2. Personal and other Visitors confidential data are processed (stored) during the period necessary for the implementation of the specified processing purposes. The Visitor can withdraw his consent to processing, in which case HAISTER GIN as the owner of personal data can continue further processing (storage) of data only if there are other legal grounds for processing and only within the limits determined by such grounds.

4. PROCEDURE FOR PROCESSING PERSONAL AND OTHER CONFIDENTIAL DATA OF SITE VISITORS

4.1. The processing of personal and other confidential data of the Visitors is carried out in accordance with the requirements of the current laws of Ukraine.

4.2. HAISTER GIN may collect personal and other confidential data in the following ways:

• automatically on the Site;
• by the Visitor filling out information in certain forms on the Site;
• by the Visitor providing data during communication with a representative of HAISTER GIN. 4.3. The following information about the Visitor is recorded automatically on the Site:
• domain name and/or IP address from which the Visitor accesses the Site;
• type of browser and operating system;
• date and time of visiting the Site;
• viewed pages;
• the web address of another site, the link from which the Visitor went to the Site;
• the web address of another site, the link from which the Visitor went to the Site;
• information about the connection, traffic, duration of the Visitor's work on the Site, the number of bytes transferred during the session.

4.4. Information about traffic passing through the network, e-mail, and the activity of the Visitor on the Internet on the Site is protected in accordance with the laws of Ukraine. The site cannot in any way interfere with the secrecy of telecommunications.

4.5. Cookies are used to ensure the launch and maintenance of security functions during the operation of the Site. Cookies are also used to track violations by Visitors/devices of this Privacy Policy and the Site Terms of Use.

4.6. By using the Google Analytics system, the Site visit statistics are collected, including information about visited pages, the number of their views, downloaded information, domains of Internet providers and countries of origin of Visitors, addresses of websites visited before and after the Site, etc. None of these actions are linked to the Visitor personally and are measured only in the aggregate.

4.7. When placing an Order on the Site, the Buyer may be asked to provide the following data:

4.7.1. Mandatory to provide there is the following data/information:

- Surname, first name and patronymic of the Visitor;

- e-mail and mobile phone number of the Visitor.

4.7.2. Additional data/information:

- the Visitor’s date or year of birth;

- information about brand preferences;

- information regarding interest in a particular product or service;

- reviews and offers;

- etc.

4.8. By filling out the Order form, the Visitor consents to the processing of his personal and other confidential data by HAISTER GIN/Site.

4.9. HAISTER GIN does not transfer the Visitor's personal and other confidential data to third parties, except when such transfer is required by law, at the request or with the consent of the Visitor or in other cases set forth in this Privacy Policy.

4.10. HAISTER GIN has the right to provide personal data and/or any other Visitor’s personal information:

• by court decision, at the legal request of law enforcement agencies and/or other competent authorities within the framework of the procedures stipulated by the current laws of Ukraine;
• communication operators, call centers (call processing centers), product manufacturers or their representatives, distributors with whom relevant contracts have been concluded;
• in other cases directly provided for by the current laws of Ukraine.

5. LIMITATION OF LIABILITY

5.1. The Site’s Visitors use the Site at their own risk. HAISTER GIN does not bear any responsibility for lost profit, unearned profit, loss of data or any other losses (damage) of the Site’s Visitors, if such losses (damage) occurred during the use of the Site.

5.2. Within the maximum limits allowed by the current laws of Ukraine, neither HAISTER GIN nor any other party involved in the creation, production or maintenance of the Site shall be liable for any direct, indirect or incidental damage that may have been caused by the Visitor having access to the Site, used it or relied on it, even if the Visitor has been warned of the possibility of such damages and losses.

6. PROTECTION, STORAGE AND DELETION OF DATA

6.1. To ensure the protection of personal and other confidential data of the Visitors, HAISTER GIN complies with the requirements of international standards and uses best practices in the field of information security. In particular, the systems and software and technical means of the Site are equipped with everything necessary to prevent loss, theft, unauthorized destruction, distortion, forgery, copying of information and comply with international and national standards, including the PCI DSS standard. In addition, HAISTER GIN concludes agreements with its employees and contractors, which provide for confidentiality obligations.

6.2. The Visitors have the possibility to change or delete their personal/contact data and/or withdraw their consent to the collection and processing of personal data by sending a message to the email address listed in the “Contacts” section.

7. CHANGES TO THE PRIVACY POLICY

7.1. The Privacy Policy may be changed and/or supplemented from time to time.

7.2. All changes and additions to this Privacy Policy are published by HAISTER GIN on this web page of the Site and, unless otherwise stated directly in the text of the respective changes, take effect from the date of their publication.

7.3. HAISTER GIN reserves the right to publish separate privacy notices for specific applications on a case-by-case basis.

7.4. HAISTER GIN has the right to make changes to the text of the Privacy Policy at its own discretion without prior notice to Visitors/Buyers.

9. MISCELLANEOUS

9.1. This Privacy Policy is governed by the laws of Ukraine.

9.2. All disputes arising between the Visitor/Buyer and HAISTER GIN shall be resolved by negotiation. In case of failure to reach an agreement on the settlement of the dispute, the dispute is resolved in accordance with the procedure provided for by the current laws of Ukraine.
